The Bank of New York Mellon's CMBS Master and Primary Servicer Ratings Upgraded by Fitch

NEW YORK, July 20, 2009 — The Bank of New York Mellon (NYSE: BK) has announced that the primary and master servicer ratings of its Asset Solutions Division have been upgraded by Fitch Ratings as follows:

- Primary servicer upgraded to "CPS2" from "CPS2-"

- Master servicer upgraded to "CMS3+" from "CMS3"

The company also announced that Fitch affirmed its special servicer rating at "CSS3."

Fitch's rating actions were based on the recent update of Fitch's CMBS servicer rating criteria which were published on June 19, 2009. The criteria places increased emphasis on financial strength, employee experience and company participation in the current CMBS market.

According to Fitch, The Bank of New York Mellon's primary and master servicer upgrades were "due to increased emphasis on financial condition." The release also cited the fact that The Bank of New York Mellon's scoring in that areas was positively impacted during the criteria update.
