The Bank of New York Mellon's Matthew Biben Named Global Litigation Counsel of the Year

Award follows in-depth analysis of in-house counsel and legal departments worldwide by The International Law Office and the Association of Corporate Counsel

NEW YORK, July 1, 2009 — Matthew Biben, deputy general counsel and executive vice president for The Bank of New York Mellon (NYSE: BK) has been named the Global Litigation Counsel of the Year by The International Law Office (ILO) and the Association of Corporate Counsel (ACC) as part of the third annual Global Counsel Awards. These annual awards recognize lawyers for demonstrable achievements across the full spectrum of in-house responsibility.

The ILO, with the support of the ACC, conducted an in-depth analysis of more than 3,000 nominations for in-house lawyers and legal departments worldwide to determine the 2009 honorees, who were shown to have performed far above and beyond the usual requirements of their profession and position. The ILO research team focused on criteria such as effective communication, legal understanding, commercial awareness, depth and strength of team, and management skills, in addition to any significant projects or transactions. There were some 200 nominations in Biben's category.

In his role for The Bank of New York Mellon, Biben serves as chief counsel for litigation and enforcement and supervises 35 lawyers and more than 65 non-lawyers in the enforcement & investigation, employment law, and civil litigation units as well as the Office of the Corporate Secretary.

Prior to joining the company, Biben served for six years in the United States Attorney’s Office for the Southern District of New York as an Assistant United States Attorney in its Criminal Division and where he received the Attorney General’s Director Award for superior performance. Prior to that, he was an assistant district attorney in the New York County District Attorney’s Office. Biben has argued numerous appeals in the Second Circuit Court of Appeals and was lead counsel in more than 25 federal and state trials.

Additionally, Biben serves as Adjunct Professor of Law at the University of Pennsylvania Law School, a position he has held since 1994. Biben has taught seminars in legal philosophy, advanced criminal law, and federal crime.
